The petitioner seeks pre-arrest bail in connection with Bihta P.S. Case No.1026 of 2017 registered under Sections 409 and 420 of the Indian Penal Code.

It is submitted that from perusal of the FIR itself it would appear that neither the offence punishable under Section 409 nor punishable under Section 420 of the Indian Penal Code would be attracted. The grievance of the informant of the case is only to the extent of the fact that his admit card has not been issued of which the petitioner is the Principal of the college. Further contention of the petitioner is that for filling up the examination form rupees one thousand was taken as examination

Patna High Court Cr.Misc. No.43038 of 2018 (2) dt.20-07-2018 2/2 fee and other charges by the Accountant of the college for which receipt was handed over to each of the candidates and the amount was also deposited in the concerned bank standing the name of the college in Madhya Vihar Gramin Bank, Anandpur, Patna. Considering the nature of allegation and the pleadings advanced on behalf of the petitioner, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Danapur, Patna in connection with Bihta P.S. Case No.1026 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
