JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376/313/506/34 of the Indian Penal Code.
It is alleged that the son of the petitioner, namely, Shahnawaz Hussain ravished the informant when she got pregnant she was provided some medicines by the petitioner, as a result, her pregnancy got terminated.
It is submitted by learned counsel for the petitioner that there is specific accusation under section 376 IPC against the son of the petitioner, namely, Shahnawaz Hussain. There is nothing on record to suggest that pregnancy of the informant got terminated due to medicine supplied by this petitioner. The petitioner has been roped in the present case since he is father of the main accused. A
Patna High Court Cr.Misc. No.27721 of 2015 (2) dt.23-07-2015 2/2 statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Biroul at Benipur, Darbhanga in connection with Kusheshwar Asthan P.S. Case No.167 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
