====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-08-2018 Cr. Appeal (SJ) No. 1232 of 2018 was dismissed for nonprosecution as no one had appeared on behalf of the appellant, though case diary was available.

The criminal appeal was for grant of anticipatory bail in a case registered for the offences under the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 also. The present application is for setting aside the dismissal of the said criminal appeal and restoration of the same considering the grounds for non-appearance as stated in para 4 of the petition. For substantial justice, the dismissal is set aside on payment of cost of Rs.500/- (five hundred) in the Victim Compensation Fund.
