2. In the present case, the petitioner seeks bail in connection with Beldaur P.S. Case No. 372 of 2023 registered for the offences under Sections 302, 201, 353 and 120B/34 of the Indian Penal Code.
3. As per prosecution case, father of the informant was murdered and the informant named co-accused persons for being involved in the murder of his father. The name of the petitioner transpired during investigation for also being involved in the said occurrence.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Except for the confessional statement of co-accused, there is no material against the
Patna High Court CR. MISC. No.60667 of 2025(2) dt.08-09-2025 2/3 petitioner. There is no eye-witness to the alleged occurrence and no material has come up during investigation against the petitioner. A number of co-accused persons have been granted bail by different Co-ordinate Benches of this Court. Co-accused Pappu Mukhiya and Kundan Mukhia have been granted bail vide order dated 16.06.2025 passed in Cr. Misc. No. 80434 of 2024. Co-accused Sonu Kumar has been granted bail vide order dated 16.06.2025 passed in Cr. Misc. No. 81233 of 2024. Coaccused Sabnam Devi, Sunita Devi and Savita Devi have been granted bail vide order dated 05.07.2024 passed in Cr. Misc. No. 34458 of 2024. Co-accused Chandan Mukhiya has been granted bail vide order dated 27.06.2025 passed in Cr. Misc. No. 22480 of 2025. The case of the petitioner is on better footing. Petitioner is in custody since 15.06.2025 and charge-sheet has been submitted. Petitioner is having antecedent of two cases in which he is on bail.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation without any substantive material and also considering grant of bail to other co-accused persons, the
Patna High Court CR. MISC. No.60667 of 2025(2) dt.08-09-2025 3/3 petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Khagaria/concerned court in connection with Beldaur P.S. Case No. 372 of 2023, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
