The petitioners are apprehending their arrest in connection with Tisiauta P.S. Case No. 67 of 2015 for the offences instituted under Sections 302/34 of the IPC.
The prosecution story, in brief, is that on 25.12.2015 when the informant was going to his home by his tractor, in the meantime, the petitioners came and restrained the way and told him that the way is close. Thereafter, the accused persons started pelting bricks and stones upon him. When the informant's father came to rescue he was also assaulted by bricks and punch as a result of which he died. Co-accused Bhushan Singh assaulted
Patna High Court Cr.Misc. No.15632 of 2016 (2) dt.03-05-2016 2/2 upon him by Iron rod.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. For a petty reason, a hot exchange took place and due to the same, the deceased sustained injury and he succumbed to death. No specific injury is attributed. General and omnibus allegation has been made. Petitioner no. 1 is a lady.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Tisiauta P.S. Case No. 67/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
