ANJANA MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Nagar P.S. Case No.798 of 2015 for allegedly having committed the offence under Sections 420, 467, 468, 471/34 of the Indian Penal Code.
The allegation against the petitioner is that she has taken employment on the basis of fake B.Ed. degree. Learned counsel for the petitioner submits that actually, the said degree is not a fake one, rather the Institution, as referred to, is an affiliated one, though the same is an off campus institute and she has taken the certificate
Patna High Court Cr.Misc. No.21621 of 2016 (4) dt.20-08-2016 2/2 from the same.
In the present case, case diary had also been called for, which has since been received.
With reference to the supervision note, learned counsel for the State submits that prima facie the case has been found to be false.
In view of such facts and circumstances, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Nagar P.S. Case No.798 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
