The petitioner seeks bail in Bodh Gaya P.S. Case No. 316 of 2021, registered for the offence under Sections 379, 411, 413 of the Indian Penal Code.

petitioner was arrested with stolen motorcycle . It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to village politics. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent and he is in custody since 28.8.2021. Investigation is complete. Similarly situated co-accused has already been allowed bail by this Court vide order passed in Cr.Misc.No. 70006/21.

Learned A.P.P. for the State has opposed the bail

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Bodh Gaya P.S. Case No. 316 of 2021.
