The petitioner seeks bail in connection with Sheikhopur Sarai P.S. Case No.29 of 2021 registered for the offence punishable under Sections 406, 420, 467, 468, 471, 120B of the Indian Penal Code.

The police party has proceeded to verify information received regarding some young persons indulging in cheating and fraud by use of mobile phone. One co-accused Swapnil Santosh Prasad has been arrested, who has allegedly stated the name of 26 persons who are also indulging in this act of fraud and cheating.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.60103 of 2022(2) dt.19-01-2023 2/3 because the petitioner has antecedents of similar nature, on suspicion, he has been implicated in this case. Several coaccused persons, namely, Swapnil Santosh Prasad, Manish Kumar, Sonu Kumar @ Patel Indrajeet, Akalu Kumar @Manish Kumar, Sandeep Kumar, Takla @ Bikas Patel and Purushottamm Kumar, have been allowed bail by the court below itself. The petitioner is in custody since 08.09.2022. The learned APP for the State has opposed the prayer for bail.

Considering the rival submissions, manner of petitioner's implication and the fact that now the investigation is complete, this Court for the purposes of grant of bail is inclined to accept the submissions advanced by the petitioner's counsel. Prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhopur Sarai P.S. Case No.29 of 2021, subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
