JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This application, for grant of anticipatory bail, arises out of Kasba P.S. Case No. 302 of 2018 disclosing offences under Sections 147, 149, 341, 323, 325, 307, 379, 427 and 504 of the Indian Penal Code.
Prosecution case is that while the informant and his family members were at home, then F.I.R. named accused persons including the petitioners along with large number of others came with deadly weapons and started assaulting the family members of the informant. It is further alleged that one Md. Najrul Haque assaulted by means of sword causing head injury and Abdul Rajjak received fracture injury
Patna High Court CR. MISC. No.59390 of 2019(2) dt.19-09-2019 2/2 on his head and Md. Nasir & Ainul Haque received fracture injury and other family members of the informant were also brutally assaulted. They also demolished the house and took away Rs. 80,000/-.
Submission of learned counsel for the petitioners is that as a matter of fact informant and others have tried to outrage the modesty of sister of petitioner no. 3, in which, some occurrence took place. Moreover, no specific allegation has been attributed to the petitioners and now the matter has also been compromised. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Kasba P.S. Case No. 302 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
