JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 22.02.2016 in a case registered for the offences punishable under Sections 436/34 of the Indian Penal Code and Section 27 of the Arms Act. Admittedly, the informant is not an eye witness of the alleged occurrence and the alleged occurrence was witnessed by his parents. In course of investigation, father of the informant claimed that he had seen petitioner no. 2 fleeing from the place of occurrence and one witness, namely, Sushil Yadav claimed that petitioner no. 1 was making firing at the time of alleged occurrence.

No.16189 of 2016 (2) dt.22-04-2016 2/2 Admittedly, there was land dispute between the parties and, therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Brajesh Kumar, Judicial Magistrate 1st Class, Khagaria in connection with Gogri P.S. Case No. 29 of 2015.
