The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 419 and 34 of the Indian Penal Code.

As per the prosecution case, the petitioner along with accused persons were caught while demanding a sum of Rs. 1000/ to enable the victims of flood for getting an amount of Rs. 6000/ by way of a flood relief.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No such occurrence as alleged has taken place. He is in custody since 20.9.2021 and chargesheet has been submitted in the case. The coaccused Munna Kumar has been enlarged on bail vide

Patna High Court CR. MISC. No.88 of 2022(2) dt.08-06-2022 2/2 order dated 23.12.2021 passed in Cr. Misc. No.68839 of 2021. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the grant of bail to coaccused Munna Kumar together with the petitioner having remained in custody for more than 8 months and chargesheet has been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Turkauliya (Banjaria) P.S. Case no. 736 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari.
