JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No one appears on behalf of the opposite party no. 2. Petitioner apprehends his arrest in connection with Complaint Case No. 1593 of 2012 registered for the offences punishable under Section 498A of the Indian Penal Code. The marriage of the complainant was solemnized with the petitioner in the year 2002 and after ten years of the marriage the complainant filed the case against the petitioner. It appears from the contents of the complain petition that the complainant led her married life with the petitioner and gave birth to two children

Patna High Court Cr.Misc. No.54326 of 2013 (4) dt.23-03-2015 2/2 but later on, she made allegation against the petitioner regarding illegal demand and torturing.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Vaishali at Hajipur in Complaint Case No. 1593 of 2012 corresponding to trial no. 4202 of 2012, subject to condition as laid down under Section 438(2) of the Cr.P.C.
