The petitioners seek pre-arrest bail in connection with Bidupur P.S.Case No.105 of 2013 registered under Sections 366 and 372/34 of the Indian Penal Code.

Regard being had to the serious nature of allegation made in the FIR based on a complaint and the statement of the victim recorded under Section 164 of the Code of Criminal Procedure, I am not inclined to grant pre-arrest bail to the petitioners.

Accordingly, the application preferred under Section 438 of the Code of Criminal Procedure is hereby rejected with observation that in case the petitioners surrender and seek bail, the
