JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-04-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 494/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that this is the fourth case lodged by the informant against the petitioner under Section 498A of the IPC. The informant earlier filed complaint case No. 217 (c) of 2007 under Section 498A of the IPC, which was disposed of under Section 203 of the Cr.P.C. on 11.07.2008. Thereafter, the informant lodged Inerwa P.S. case No. 29 of 2012 under Section 498A of the IPC in which the petitioner was granted provisional anticipatory bail vide Cr. Misc. No. 39640 of 2012 on 18.10.2012. The said order dated 18.10.2012 was modified by this court vide order dated

Patna High Court Cr.Misc. No.16019 of 2016 (2) dt.11-04-2016 2/2 05.08.2015 in Cr. Misc. No. 32726 of 2014 and in the light of order dated 05.08.2015, learned court below granted regular bail to the petitioner. Again Complaint case No. 218 (C) of 2015 was lodged by the informant under section 498A of the IPC, which is pending under enquiry.

Considering the repeated cases lodged by the informant under section 498A of the IPC against the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sitesh Kumar, learned JM, 1st class, Bettiah in connection with Inerwa P.S. Case No. 16 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
