2. The petitioner has moved the Court under Section 482 of the Code of Criminal Procedure, 1973 for the following relief:

"That this is an application to quash the order dated 13.5.2013 passed by Judicial Magistrate 1st Class Muzaffarpur (East), passed in Tr. No. 3255/13, Gr. No. 1607/09, arising out of Sakara P.S. Case No. 191/2009, for the offence alleged under section 420, 467, 468/34 of the I.P.C., thereby rejected the petition filed by the petitioner under section 239 of Cr.P.C. to discharge him on the ground that from the allegation as alleged in the first information report as well as in course of investigation no evidence adduced against the petitioner."

3. After some arguments, learned counsel for the

Patna High Court CR. MISC. No.51724 of 2014(5) dt.03-04-2019 2/2 petitioner sought permission to withdraw the application.

4. Learned A.P.P. does not oppose.

5. In view thereof, as prayed for by learned counsel for the petitioner, the application stands disposed off as withdrawn.
