1. Heard learned counsel appearing on behalf of the parties.

2. The present modification application has been filed for modification of the order dated 10.08.2022 passed in Cr. Misc. No. 13530 of 2022 regarding condition No. (i), which runs as under:- "That accused/petitioner shall cooperate in the trial and shall be physically present on each and every date before the Trial Court till conclusion of the trial and exemption from physical appearance be allowed by the Trial Court, only on medical ground of the petitioner, duly supported by the documents."

3. It is submitted by learned counsel that

Patna High Court CR. MISC. No.76254 of 2023(6) dt.13-03-2024 2/2 petitioner is a lady and she resides at Bhagalpur, and as such, on each and every date of hearing, it is very cumbersome to her. It is submitted that still this matter is at the stage of appearance, therefore the condition as imposed aforesaid be modified considering the difficulties faced by petitioner

4. Considering the submission as above, the condition no. (i) as imposed above shall be operational only after framing of charge. Condition No. (i) as above stands modified accordingly.

5. With aforesaid modification, the present modification petition stands disposed of.

6. This order shall be treated as a part of order dated 10.08.2022 passed in Cr. Misc. No. 13530 of 2022.
