2. Heard learned counsel for the petitioner.

3. The petitioner has approached this Court seeking direction to the learned Additional Principal Judge, Family Court, Patna to dispose of Matrimonial Case No. 883/2018 filed by the respondent under Section 13 of the Hindu Marriage Act at the earliest.

4. The learned counsel for the petitioner submits that the petitioner is the wife of respondent and respondent has filed matrimonial case for dissolution of marriage. But the said case has been filed only to harass the petitioner as the respondent

Patna High Court C.Misc. No.972 of 2024 dt.09-12-2024 2/3 does not make proper pairvi in his case and the learned trial court is very liberal in granting adjournments to the respondent and the matter has been coming at the stage of evidence of the respondent since 2019 and till date, it is running at the same stage. The learned trial court neither dismisses the petition nor forces the respondent to bring his evidence and allow the matter to conclude.

5. Since it is the matter seeking direction to the learned trial court for expeditious disposal of the aforesaid matrimonial case, I do not think there is any need to issue notice to the respondent.

Having considered the aforesaid facts and circumstances as well as submission made on behalf of the petitioner, the learned Additional Principal Judge, Family Court, Patna is directed to expedite the proceedings of Matrimonial Case No. 883/2018 and try to conclude the same at the earliest on its merits and in accordance with law preferably within a period of six months from the date of receipt/production of a copy of this order, without adjourning the matter unnecessarily.

7. At the same time, the parties are directed to cooperate in the matter for its early disposal without seeking unnecessary adjournment.
