The petitioner apprehends his arrest in Shivsagar P.S. Case No.215 of 2019 registered under Sections 30(a) and 41 of Bihar Prohibition and Excise Act.

The police intercepted a vehicle but the occupants of the vehicle started fleeing away. From the vehicle, some bottles of Indian made foreign liquor were recovered. Two persons were apprehended who disclosed their names as Jay Prakash Kumar and Bitu Paswan. The petitioner was the driver of the vehicle and he managed to flee away.

The learned counsel for the petitioner submits that persons who were apprehended on chase were carrying the liquor. Nothing has been recovered from the possession of the petitioner. The seizure list does not bear the signature of any

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
