The petitioner is languishing in custody for the offences punishable under Sections 279/337/338 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Liquor was recovered from the motorcycle of the petitioner when the petitioner and brother-in-law of the petitioner were both on the same motorcycle. The brother-in-law of the petitioner was driving the motorcycle. The petitioner has got a criminal antecedent of identical nature. Submission is that in the earlier case recovery of liquor was from the house of the brother-in-law and petitioner was allowed anticipatory bail.

No.57518 of 2019(2) dt.13-09-2019 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail if the trial is not concluded within six months from the date of framing of the charges on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kursela P.S. Case No.73 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
