The petitioner apprehends his arrest in connection with Hisua P. S. Case No. 50 of 2017 instituted under Sections 366A/34 of the Indian Penal Code.

The allegation, in brief, is that petitioner enticed away the minor daughter of the informant.

Submission is that the girl was major 18 years of age and the learned Magistrate, while recording statement under Section 164 Cr.P.C., has assessed her age 19 years and there is no medical examination regarding her age and she admitted in her statement of marring with the petitioner willfully and is living as wife and husband.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.37759 of 2017 (2) dt.11-08-2017 2/2 circumstances, let the petitioner, namely, Pankaj Kumar in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Hisua P.S.Case No. 50 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
