Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under sections 302, 307, 427, 120B of the Indian Penal Code and section 27 of the Arms Act. Petitioner is not named in the first information report and for the first time, name of the petitioner surfaced in this case in the confessional statement of co-accused Sunil Rai. The informant who claims himself to be an eye witness has stated nothing against the petitioner. However, even if the confessional statement of Sunil Rai is assumed to be true then also no specific

No.16330 of 2016 (2) dt.22-04-2016 role has been assigned to the petitioner and it is only stated that he was involved in the conspiracy in the murder of the deceased and except the aforesaid material there appears to be nothing against the petitioner, who is in jail custody since 10.03.2016. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Jabin Jamal, Judicial Magistrate, 1st Class, Patna City in connection with Fatuha P.S. Case No. 56 of 2016.
