This is an application for regular bail on behalf of the petitioner for the offence alleged under section 30(a) of Bihar Prohibition of Excise Act, 2018.
As per allegation, the police got information that the petitioner and co-accused Anup Ram had stored liquor in mango orchard. On raid, 267 liters of liquor was recovered from mango orchard.
Learned counsel for the petitioner has submitted that the petitioner was not caught at the spot and nothing was recovered from
Patna High Court CR. MISC. No.186 of 2022(2) dt.30-05-2022 2/2 his conscious possession and he is in custody since 02.09.2021. Considering the period of custody of the petitioner, let the petitioner above named be released on bail only after framing of the charge on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II-cum-Special Judge, Excise Act, Buxar in connection with Rajpur P.S. Case no. 09 of 2021. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court.
