Petitioner apprehends his arrest in connection with Khagaria (Muffasil) P.S.Case No. 340 of 2018 registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

Allegation as per FIR is that one motorcycle was recovered from the possession of co-accused, who has named this petitioner, from whom he has purchased the same. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and petitioner has no criminal antecedent and except confessional statement there is nothing against him.

Heard learned APP also.

No.45350 of 2018 (2) dt.02-08-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Muffasil) P.S.Case No. 340 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
