The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 379 of the Indian Penal Code.
Prosecution case is that on 25.01.2016 at 7.00 p.m., the younger daughter of the informant namely Chhoti Kumari was playing at the door of the petitioner when the petitioner started assaulting her. On hearing cry of her daughter, the informant rushed to rescue her when petitioner threw the informant on the ground and with knife cut right ear of the informant and snatched ear-ring.
It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled. Though
Patna High Court Cr.Misc. No.16695 of 2016 (2) dt.19-04-2016 2/2 injury on the ear of the informant has been found to be grievous. Considering the nature of accusation, it is a case for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Kuchaikot P.S. Case No.21/2016, pending before the learned CJM, Gopalganj. With the above observation, this application is, accordingly, disposed off.
