The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 354/34 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. The prosecution case is that while the daughter of the informant was grazed her Cow, accused person started abusing and assaulting her with fists and slaps. When the informant went to rescue, she was also assaulted and abused by calling caste name.
It is submitted by the learned counsel for the petitioners that for a petty dispute accusation has been levelled. The informant has retracted from the initial version
Patna High Court Cr.Misc. No.18135 of 2016 (2) dt.27-04-2016 and filed a petition to that effect before learned court below. Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Darbhanga in connection with A.P.M. P.S. Case No. 87 of 2013, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
