This application for anticipatory bail arises out of Chapra Town P.S. Case No. 316 of 2019, disclosing the offence under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code.

There is general and omnibus allegation of assault against the persons named in the FIR. My attention has been drawn to the fact that Chapra Town P.S. Case No.315 of 2016 has been lodged by one Piyush Kumar against the persons of informant's side. He further contends that the injuries have been found to be simple in nature.

Considering the above, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender

Patna High Court CR. MISC. No.57976 of 2019(2) dt.13-09-2019 2/2 within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand), with two sureties of the like amount, each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S Case No. 316 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bounds shall be liable to be cancelled.
