JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 420 and 409 of the Indian Penal Code. The allegation against the petitioner is that he withdrawn excess money of Rs. 16,75,000/- whereas only Rs. 67,310/- was available for the payment in the NAREGA. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is a Post Master in the Postal Department. From perusal of the FIR it appears that excess withdrawal to the tune of Rs. 16,75,000/- has been made by the petitioner but subsequently the said amount has been deposited by the petitioner in the concerned account. Hence no wrongful loss has been caused to the State by the petitioner.
Patna High Court Cr.Misc. No.27998 of 2015 (3) dt.29-09-2015 2/2 On behalf of the State it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Daudnagar, District- Aurangabad in connection with Goh P.S.Case No. 19 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
