ANJANA MISHRA ORAL ORDER 15-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.06.2019 in connection with Katihar Town P.S. Case No.321 of 2019 registered for the offence under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R. but only on account of personal grudge and local politics, the name of the petitioner has been drawn in in the confessional statement made before the police by one Dilip Sahni. It is further submitted that the petitioner was remanded in connection with the present case on the basis of the said confessional statement and there has been no recovery of either looted cash or ornaments from the

Patna High Court CR. MISC. No.60456 of 2019(2) dt.15-10-2019 2/2 possession of the petitioner nor has he been placed on T.I. Parade. It is further submitted that save and except one case under the Excise Act, the petitioner has no other case. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Katihar Town P.S. Case No.321 of 2019.
