ANJANA MISHRA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 28.5.2014 in connection with Sessions Trial No.549/2014 arising out of Akodhi Gola P.S. Case No.59 of 2014 registered for the offences under Sections 326, 307/34, 120B of the Indian Penal Code. The allegation against the petitioner is that her husband was brutally assaulted by the petitioner and one co-accused Chhottu Kharwar, which fact she learnt from one Rakesh Kharwar, who informed her telephonically. However, there is no eye-witness in the case.

Learned counsel for the petitioner submits that there is no evidence whatsoever so as to implicate the petitioner in the

Patna High Court Cr.Misc. No.46637 of 2014 (2) dt.16-02-2015 2/2 present case and his name has been brought on the basis of mere suspicion.

Considering the aforementioned submissions and the facts that the petitioner has been in custody since 28.5.2014 and has clean antecedents, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-Vth, Rohtas at Sasaram, in connection with Sessions Trial No.549/2014, arising out of Akodhi Gola P.S. Case No.59 of 2014.
