ANJANA MISHRA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners being the uncle and aunt of accused Bhola Ram are apprehend their arrest in connection with a case registered for the offences punishable under Sections 341/323/366/366(A)/379 and 120(B) of the Indian Penal Code. Learned counsel for the petitioners submits that from bare perusal of the First Information Report, it appears that no specific role has been assigned to the petitioner, save and except, the fact that a bald allegation has been made stating that when enquiry was being made by the informant regarding his daughter, the petitioner No. 1 and his wife assaulted the informant.
Considering the nature of allegations made and that the role of these two petitioners are rather vague and indistinct, let the
Patna High Court Cr.Misc. No.18152 of 2016 (3) dt.21-06-2016 P2/2 petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Panapur P.S. Case No. 77/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
