Petitioner is not named in the first information report and his name surfaced in this case in course of investigation and it appears that no specific overt act has been attributed against him and it is alleged that petitioner was only a member of an unlawful assembly. Moreover, having more or less similar allegation, several co-accused persons have already been granted privilege of bail by different Benches of this Court.
