JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are apprehending their arrest in connection with Daudnagar P.S. Case No. 188 of 2014 for the offences instituted under Sections 147, 148, 149, 323, 307 and 379 of the IPC.

The prosecution story, in brief, is that on 06.07.2014 at 4.00 P.M., the informant was at his house, in the meantime, Rameshwar Prajapati, Arbind Prajapati, Ranjit Prajapati, Sriman Prajapati, Prahlad Prajapati and Om Prakash armed with Lathi,

Patna High Court Cr.Misc. No.26614 of 2015 (3) dt.23-09-2015 2/2 Iron rod entered into his house and started abusing and assaulting on the head of his wife and other part of her body causing head injury and when he and his son and daughter-in-law attempted to rescue her, they were also assaulted by them and they taken Rs. 500/- from his box.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is a case and counter case. Both the petitioners are the Gotias and there is an admitted land dispute between the parties.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Daudnagar P.S. Case No. 188/2014 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
