JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Bochahan P.S. Case no. 32 of 2017, registered under Sections 420, 467, 468 and 471/34 of the Indian Penal Code. The accusation is that on enquiry the TET Certificates of 35 Panchayat Teachers, who were appointed in Bochaha block, were found fake.

Learned counsel for the petitioners submits that the TET result card of the petitioners, which is placed at Annexure-2, are true. Further submission is that neither in the F.I.R. nor in the case diary, which is up to paragraph 30 it has not detailed that how the enquiry was made about verifying the TET result. Further submission is that, in fact, the petitioners were appointed on contract basis and at present

Patna High Court Cr.Misc. No.35499 of 2017 (3) dt.09-11-2017 2/2 they have already been removed after completion of their contract. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Judge-II-cum-Addl. Chief Judicial Magistrate, Muzaffarpur in connection with Bochahan P.S. Case No. 32 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
