1. Heard learned counsel for the petitioners and the learned A.P.P. for the State.
2. The petitioners apprehend arrest in connection with Nirmali P.S. Case No. 123 of 2023 registered under Sections 287, 419, 420 of the Indian Penal Code and 23 PC & PNDT Act.
3. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Further he submits that petitioner no.1 is a proprietor of the Hariom Ultrasound. His license was valid for five years(Annexure-P2). Further he submits that petitioner no. 1 has already filed an application for
Patna High Court CR. MISC. No.67245 of 2023(2) dt.18-10-2023 2/2 renewal/extension of the registration of Ultrasound, as contained in Annexure-P3. Further he contended that petitioners have no criminal antecedent.
4. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Judicial Magistrate, 1st Class, Birpur, Supaul in connection with Nirmali P.S. Case No. 123 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
