The petitioners apprehend their arrest in connection with Phulwari Sharif P.S. Case No.565 of 2019 registered under Sections 323, 324, 325, 341, 307, 504 and 506/34 of the Indian Penal Code. The accusation is that Ram Prasad Singh, the husband of the informant Phulmanti Devi, was mercilessly assaulted by her son Vinay Kumar Singh (petitioner no.1) and daughter-in-law Punam Devi (petitioner no.2/the wife of the petitioner no.1), due to which the husband of the informant sustained cut injury on his head at 3 places, hand and fracture injury on his right hand. While he was rushed for treatment at Phulwari Sharif Hospital but after giving treatment to him, he was referred from there to P.M.C.H. The

No.59260 of 2019(2) dt.19-09-2019 2/2 husband of the informant is being threatened by the petitioners that they would kill him next time in case his life is saved this time. Learned counsel for the petitioners submits that the petitioners are son and daughter-in-law of the informant and due to land dispute in between the petitioner no.1 and his brother Santosh Kumar Singh, Santosh Kumar Singh got managed her mother to implicate the petitioners in a false case. Moreover, only two injuries were found on the person of the husband of the informant, which are simple in nature. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Phulwari Sharif P.S. Case No.565 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
