The petitioner is in custody since 19.07.2019 in connection with C-III Case No. 173 of 2019 registered for the offence punishable under Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries are from a bag which does not belong to the petitioner, but has been saddled on his shoulder. Considering the aforementioned facts and circumstances of the case and that the alleged recoveries were not from his conscious possession, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like
