However, during the pendency of the present case, charge sheet has been filed and cognizance has been taken by the learned trial court, hence he prays for withdrawal of the present petition with a liberty to challenge the order taking cognizance. The prayer is allowed.

The present petition is dismissed as withdrawn with the liberty aforesaid.
