2. The petitioner has preferred this application for grant of regular bail in connection with Musrigharari P.S. Case No. 118 of 2022, registered under sections 302 and 34 of the Indian Penal Code.

3. As per prosecution case, the informant states that he learnt about the death of his mother namely Uma Devi having occurred as a result of hanging with electric wire. The informant states that his father was in an extra marital relationship with the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case on the unsubstantiated allegation of having some illicit relationship with the husband of the deceased. In any case, no material has transpired to connect the petitioner with the alleged crime. In

Patna High Court CR. MISC. No.63557 of 2023(2) dt.11-10-2023 2/2 fact the husband of the deceased who was an accused has been acquitted by the learned trial court by Judgment brought on record as Annexure- P/2 in the application. The petitioner is in custody since 11.06.2023 and charge-sheet has been submitted in this case. The petitioner undertakes to cooperate in the trial.

5. Learned APP for the State has opposed the prayer of bail.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the F.I.R., the contents of the judgment of coaccused Deo Narayan Rai acquitting him in the trial, the petitioner being in custody since 11.06.2023, charge-sheet having been submitted in this case and the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Musrigharari P.S. Case No. 118 of 2022, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Samastipur.
