This application, for grant of anticipatory bail, arises out of Pirbahore Police Station Case No. 193 of 2017, disclosing offences under Sections 381 and 406 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, earlier the petitioner himself lodged a case against the informant in Labour Court for payment of his admissible dues and on account of that this petitioner has falsely been implicated in this case. Hence, the petitioner deserves the privilege of anticipatory bail. Learned A.P.P. for the state has opposed the prayer

Patna High Court Cr.Misc. No.40155 of 2017 (2) dt.21-09-2017 for bail and submitted that in the C.C.T.V. footage, the petitioner was found stealing medicines and the witness have also supported the prosecution version, which is evident from paragraphs nos. 7, 12, 13, 14 of the case diary. Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail. Accordingly, the prayer for anticipatory bail of this petitioner is rejected.
