The petitioner has preferred this application for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.
As per the prosecution case, on information having been received about the accused persons planning to give effect to an occurrence, it is stated that a raid was conducted and four accused persons were caught. It is further stated that one of the accused who was caught disclosed that they were called by the petitioner for giving effect to an occurrence. It is submitted by learned counsel for the petitioner that from the FIR itself it would transpire that neither the petitioner was arrested at the spot nor any incriminating article
Patna High Court CR. MISC. No.222 of 2022(2) dt.08-06-2022 2/2 has been recovered from his possession. He is in custody 30.6.2021 and cause of his false implication is his antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the petitioner not having been arrested at the spot, his having remained in custody for 11 months and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Bahadurganj P.S. Case no. 337 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj.
