JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 17.03.2016 in a case registered for the offences punishable under sections 20 and 22 of the N.D.P.S. Act.

The prosecution case is that the police received information that Ganja is being sold by the miscreants, raid was laid and from the cot of Sukumar Yadav 4 Kg. Ganja was recovered. The petitioner was found present there. It is submitted by learned counsel for the petitioner that recovery of contraband is not from the petitioner. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.19420 of 2016 (2) dt.03-05-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Saharsa in connection with Special case No. 01/ 2016 (Arising out of Saharsa Sadar P.S. Case No. 212/2016).

The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in similar offence or defaults without any reasonable cause on three consecutive occasions.
