The petitioner seeks bail in connection with Mushahari P.S. Case No. 75 of 2021, registered for the offence under Sections 25(1-b)A, 26 and 35 of the Arms Act. As per prosecution case, one country-made loaded pistol and one mobile phone has been recovered from the possession of the petitioner.

It is submitted on behalf of the petitioner that mobile phone which was recovered from the possession of the petitioner is not stolen one and he is in custody since 06.04.2021.

Learned APP for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances and period of incarceration,

Patna High Court CR. MISC. No.690 of 2022(2) dt.21-03-2022 2/2 bail petition of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Xth, Muzaffarpur, in connection with Mushahari P.S.
