The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 411, 413 and 414 of the Indian Penal Code.
The informant got information that some persons were unloading the solar plates near the house of Vijay Miyan. The police raided the place and apprehended three persons namely Rajesh Yadav, Budur Mandal and Raj Kumar Yadav. On their disclosure the name of the petitioner surfaced in the case. Five solar plates and one thrasher machine are said to have been recovered from the house of the petitioner.
It is submitted that there is no report of theft. The recovered articles were not stolen.
It appears that the apprehended accused persons Budur
Patna High Court Cr.Misc. No.30521 of 2015 (2) dt.30-07-2015 2/2 Manda @ Vijay Mandal, Rajesh Yadav and Raj Kumar Yadav have already been enlarged on regular bail in Cr. Misc. Nos. 21129 of 2015 and 22588 of 2015 on 14.07.2015. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order and the court below shall dispose of the bail petition on the same day taking into consideration that the apprehended accused have already been enlarged on bail.
