JUSTICE SHIVAJI PANDEY ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Sonepur/Hajipur Rail P.S. Case No. 22 of 2016 registered for offences under sections 379/411/34 of the Indian Penal Code. An allegation has been made that when the Informant entered into railway coach and was trying to go in the reserved compartment, his wife shouted that her purse was snatched by some ladies. With the help of police, all the three ladies was arrested and the purse containing Rs. 10,320/- was recovered from them. It has been alleged that they are the member of the gang. The operate in a very systematic manner.

Learned counsel for the petitioners submits that nothing was recovered from the possession of the petitioners. Both the petitioners are female.

Patna High Court Cr.Misc. No.18453 of 2016 (2) dt.05-05-2016 Looking to the facts and circumstances of the case, let the petitioners, namely, Kajal Pasi and Anjali Pasi be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, Saran in connection with Sonepur/Hajipur Rail P.S. Case No. 22 of 2016, subject to the condition that (i) one of the bailors shall be a close relative of the petitioners (ii) if the petitioners are found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of their bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioners would cooperate the proceeding of the court below.

In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds and (iv) the petitioners will report to the Sonepur/Hajipur Rail Police Station by 7th of every month for at least six months and in case of failure without any valid rhyme or reason, the bail of the petitioners will be treated to have been cancelled.
