2. The petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.
3. As per the prosecution case, on getting secret information regarding selling of illicit liuqor on Maruti Swift car, police party reached at the marked place. On seeing the police vehicle petitioner and co-accused tried to flee away but on chase the petitioner was apprehended. On search, total 109.63 litres of foreign liquor was recovered from the said Maruti Swift car.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He was neither owner nor driver of the seized car rather he was a mere passenger. He has no concern with the seized liquor. Nothing incriminating material was recovered from the conscious possession of the petitioner. He had no knowledge about the seized liquor kept in the seized car. Petitioner has no criminal antecedent. He is in custody since 30.06.2025. Petitioner undertakes to co-operate in the trial of the case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court No. 1, Patna, in connection with Special Case No. 937 of 2025 arising out of Sri Krishnapuri P.S. Case No. 169 of 2025.
