2. The petitioner is a lady who is in custody since 01.07.2023 in connection with Nathnagar (Lalmatiya) P.S. Case No. 157 of 2023 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. As per the F.I.R., co-accused Raj Kumar Chaudhary is the assailant of the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and she has been falsely implicated in this case. Learned counsel for the petitioner further submits that the co-accused Raj Kumar Chaudhary is said to have fired upon the deceased. The petitioner has no criminal antecedent.

5. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.64458 of 2023(2) dt.11-10-2023 2/2 and also the fact that the specific allegation of firing upon the deceased is against co-accused Raj Kumar Chaudhary not this petitioner, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar (Lalmatiya) P.S.
