2. The petitioners are in custody in connection with Bhabua P.S Case No. 518 of 2025 registered for the offences punishable under Sections 96, 98, 3(5) of the BNS.
3. As per allegation in the FIR, all the petitioners in connivance with each other had tried to kidnap the informant namely Puja Kumari.
4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He next
Patna High Court CR. MISC. No.61669 of 2025(3) dt.10-12-2025 2/3 submits that petitioners have falsely been implicated in aforesaid criminal case due to village politics and party bandy. It is also submitted that petitioners are next door neighbor and due to labour charge/money dispute with the family of the informant, the false case has been instituted. He further submits that from FIR only, it is clear that there is no eye witness of the alleged occurrence. He also submits that informant did not disclosed that by which manner, the occurrence was held at the 12'O Noon where several people were available near the bus stand. He further submits that victim girl is illiterate and only thumb impression has been given and the case has been instituted by the one Siyaram Mushar who has inimical term with the petitioners.
He further submits that victim girl had denied the medical examination for the assessment of the age. It is submitted by the parties that the matter has amicably been settled between both the parties and the said compromise petition is annexed as Annexure P/2. It is also submitted that petitioner is in judicial custody since 22.06.2025 having clean antecedent.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioners.
6. On perusal of the FIR, Case diary and the
Patna High Court CR. MISC. No.61669 of 2025(3) dt.10-12-2025 3/3 impugned order dated 06.08.2025, it appears that petitioner no. 1 is lady and petitioner no. 2 is husband of the petitioner no. 1 namely Sanju Devi. On perusal of the statement of the victim recorded under Section 183 of the BNS, it appears that victim girl has mentioned the name of petitioner no. 3 i.e. Soni Devi and nothing has been mentioned against petitioner no. 1 and petitioner no. 2. It is also apparent the both the parties have settled their dispute amicably and for that compromise petition is already on record. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S Case No. 518 of 2025.
