Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 307, 504 and 379 of the Indian Penal Code. It is alleged that petitioner no. 1 assaulted with sickle on the head of the husband of the informant, causing grievous injury, whereas the petitioner no. 2 assaulted with sickle, causing grievous injury on the head of Ishaque. It is submitted by the learned counsel for the petitioners that no injury has been found on the head of the husband of the informant and Ishaque. There is counter version of the occurrence and petitioners have also received injuries.
Patna High Court Cr.Misc. No.26812 of 2015 (2) dt.20-07-2015 The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Amdabad P.S. Case No. 28 of 2015, pending in the court of learned Judicial Magistrate, Ist Class, Katihar.
With this observation this application is disposed of.
