JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to the prosecution case, petitioner and two others had gone to the house of the informant to hire the vehicle and informant's nephew along with his vehicle left his home along with the petitioner and his associates but, subsequently, on the next day, two persons were caught by the villagers while they were trying to flee away after throwing the dead body of the deceased, which was, subsequently, identified by the informant as the dead body of his nephew. The apprehended co-accused Gopal Singh disclosed that deceased was killed at the house of the petitioner. The co-accused Dhiraj Kumar, who is not only said to have participated in hiring the vehicle but also in committing the
Patna High Court Cr.Misc. No.18954 of 2016 (2) dt.04-05-2016 2/2 murder of the deceased, has already been granted privilege of bail by a co-ordinate Bench of this Court and so far as petitioner is concerned, he is languishing in jail custody since 04.11.2015 and it is only stated that the murder of the deceased took place inside the house of the petitioner but no specific overt act has been attributed against the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the investigation has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Nawada in connection with Warisalliganj P.S.Case No. 266 of 2015.
