JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 6.12.2014 in a case registered for the offences punishable under Sections 147,148,149,341,121,121A,122,123,124A and 120B/302 of the Indian Penal Code, section 27 of Arms Act and sections 16,18,20 and 23 of the Unlawful Activities Prevention Act. The prosecution case is that some extremists variously armed, arrived in Pooja Pandal and caught hold of the chowkidar Arjun Mandal, dragged him and subsequently he was killed by causing fire arm injury.
It is submitted by learned counsel for the petitioner that the FIR was lodged against 11 named and 10-15 unknown when accusation is not specific and considering the omnibus and general
Patna High Court Cr.Misc. No.26562 of 2015 (2) dt.27-07-2015 and suspicious nature of accusation, co accused Bhola Mahto has been granted bail vide Cr. Misc. No. 11020 of 2015. Considering the fact that the accusation is omnibus and general, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Lakhisarai in connection with Karja P.S. Case No. 51 of 2014.
Since the petitioner is accused in two other cases, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults on three consecutive occasions.
